NIE, TIE and CUE: Understanding the Differences When Living in Málaga

Are you thinking about moving to Málaga, studying, working or buying a property in Spain? You've probably heard about the NIE, the TIE or the famous green NIE.

Although many people use these terms interchangeably, they refer to different documents with different purposes.

At Welcome Málaga, we frequently receive the same questions:

"Which NIE do I need to live in Spain?" "Do I need the green NIE or the other one?"

The answer depends on your nationality and your plans in Spain.

We'll explain the differences and share three practical examples to help you understand which document you need.

1. What Is the NIE in Spain?

The NIE (Número de Identidad de Extranjero) is a unique personal identification number assigned to foreign nationals who have economic, professional or social interests in Spain.

Both EU and non-EU citizens can obtain an NIE.

What Is the NIE Used For?

  • Buying or selling property.

  • Setting up a business.

  • Completing certain tax procedures.

  • Carrying out financial transactions.

  • Applying for residence permits.

Important: Having an NIE does not mean you have legal residency in Spain.

For example, you can obtain an NIE to buy an apartment in Málaga without having the right to live permanently in Spain.

How Do You Apply for an NIE?

Generally, you will need form EX-15, your passport or national identity card, evidence explaining the reason for your application and proof of payment of fee 790-012.

2. What Is the TIE?

The TIE (Tarjeta de Identidad de Extranjero) is a physical foreigner identity card that provides evidence of a foreign national's immigration status in Spain.

It is mainly issued to non-EU nationals who have obtained a residence permit or authorisation for a long-term stay.

For example:

  • An American woman with a non-lucrative residence permit.

  • A Mexican citizen with a residence and work permit.

  • A Colombian student completing a master's degree in Spain.

The TIE includes its holder's NIE number, but the two are not the same thing.

The NIE is the identification number; the TIE is the physical card documenting your immigration status.

How Do You Apply for a TIE?

The application is generally completed using form EX-17, together with your passport, documentation confirming your authorisation and proof of payment of the corresponding fee.

You must also attend an appointment in person to have your fingerprints taken.

3. What Is the CUE or Green NIE?

The CUE (Certificado de Registro de Ciudadano de la Unión Europea), commonly known as the green NIE, is the EU Citizen Registration Certificate.

It confirms that an eligible European citizen has registered their residence in Spain for a period exceeding three months.

It applies to citizens of the European Union, the European Economic Area and Switzerland.

Who Can Obtain a CUE?

  • Employees working for a company.

  • Self-employed professionals.

  • Individuals with sufficient financial resources and appropriate healthcare coverage.

  • Students who meet the relevant requirements.

What Documents Do You Need?

Generally:

  • Form EX-18.

  • Passport or national identity card.

  • Proof of payment of the corresponding fee.

  • Evidence of employment, studies or sufficient financial resources, depending on your circumstances.

  • Healthcare coverage, when required.

Local address registration (empadronamiento) may be necessary to prove your address in certain circumstances.

Important: The CUE is not a residence permit. It is a certificate confirming that an eligible European citizen has registered with the relevant Spanish authorities.

4. Three Practical Examples: Which Document Do You Need?

Example 1. A French Citizen Moving to Málaga for Work

Pierre is French and has accepted a job at a technology company in Málaga.

As an EU citizen, he can work in Spain without applying for a work permit.

However, if he plans to live in Spain for more than three months, he must register and obtain his CUE.

To do so, he will need his national identity card, form EX-18, proof of payment of the fee and evidence of his employment.

What does he need? The CUE (green NIE), not a TIE.

Example 2. A Retired American Woman Who Wants to Live in Málaga

Susan is 67 years old and wants to move from the United States to Málaga to enjoy her retirement.

She has a pension, savings and private health insurance.

One option she could consider is the Spanish non-lucrative residence permit.

She would need to demonstrate sufficient financial resources, appropriate health insurance and compliance with the other requirements for the relevant authorisation.

After arriving in Spain, she would need to apply for her foreigner identity card.

What does she need? A residence authorisation followed by a TIE. An NIE alone would not be enough.

Example 3. A Norwegian Student Coming to Málaga for One Year

Erik is Norwegian and will spend an academic year at the University of Málaga.

Although Norway is not a member of the European Union, it belongs to the European Economic Area.

Therefore, Erik can apply for a CUE.

Generally, he will need:

  • Norwegian national identity card or passport.

  • University enrolment certificate.

  • European Health Insurance Card (EHIC), if it provides sufficient coverage, or appropriate health insurance.

  • Evidence of sufficient financial resources.

  • Form EX-18 and proof of payment of the corresponding fee.

He will also need to complete his local address registration when applicable.

What does he need? The CUE, not a TIE.
